These guarantees are typically included within the financial bid submitted by participants in response to a tender or auction announced by the competent governmental authority. Public tenders and auctions constitute an important component of the State&#8217;s economic activity, given their significance to public funds, public finance, and the participation of the private sector and individuals in government projects through contracts commonly referred to as administrative contracts or government procurement contracts. The tendering or auction process begins with a public announcement published in the Official Gazette or on the Government Procurement Portal, inviting suppliers, contractors, or service providers that satisfy the prescribed technical and legal requirements. Participants submit two separate envelopes: a technical proposal demonstrating their qualifications, experience, and methodology in accordance with the tender documents, and a financial proposal that includes the bid security as evidence of the bidder&#8217;s seriousness. Following the public opening of the technical and financial bids, the successful bidder is selected and required to provide a performance security equal to 10% of the contract value, which is retained by the government authority until the contractual obligations have been fully performed. In order to recover the performance security, the successful bidder must fully perform all contractual obligations\u2014whether relating to leases, maintenance services, construction works, or other contractual activities, as applicable\u2014without delay in fulfilling any financial obligations arising under the contract.
